Terms & Conditions
Last updated: May 2026. These terms govern the relationship between Mow 4 U LLC ("we," "us," "our") and you ("Client," "you," "your") for all lawn care, landscaping, hardscaping, and snow removal services.
1. Scope of Services
All services provided by Mow 4 U are described in the written estimate or service agreement we provide before work begins. This document defines the scope of work, materials, timeline, and pricing. No work begins until you approve the estimate. Any additional work beyond the original scope requires a separate written agreement or change order.
2. Estimates and Pricing
All estimates are provided free of charge and are valid for 30 days from the date of issuance. Prices are based on the scope of work and property conditions at the time of the estimate. If conditions change materially (e.g., overgrowth, debris accumulation, weather damage), we reserve the right to revise the estimate.
3. Payment Terms
Payment is due upon completion of services unless otherwise specified in the service agreement. We accept cash, check, and electronic payment methods. For recurring services (e.g., weekly mowing), payment is due on the scheduled service date. Accounts past due more than 30 days may be subject to a late fee of 1.5% per month or the maximum allowed by Colorado law. Returned checks are subject to a $35 fee.
4. Scheduling and Access
For recurring maintenance services, we follow a consistent weekly schedule. Weather conditions, equipment issues, or holidays may shift service by 1–2 days without penalty to either party. You agree to provide reasonable access to the property — including unlocked gates, cleared pathways, and pets secured indoors. If we cannot access your property on a scheduled date, that service may be skipped or rescheduled at our discretion.
5. Cancellations
One-time or project-based services: cancellations must be made at least 24 hours before the scheduled start time. Recurring maintenance services: we require 7 days' written notice to pause or cancel ongoing service. Cancellations made with less than the required notice may be charged for the scheduled service.
6. Property Conditions and Hazards
You are responsible for informing us of any known hazards on the property — including underground utilities, irrigation lines, buried cables, unstable structures, or aggressive animals. Mow 4 U is not liable for damage to unmarked underground utilities, irrigation lines, or other hidden conditions we could not reasonably have known about. We will exercise reasonable care to avoid damage to existing landscaping, structures, and property features.
7. Plant Health and Warranty
We take every reasonable precaution to ensure the health of plants, turf, trees, and shrubs during our services. However, we cannot guarantee the survival or long-term health of any plant material — factors like weather, pests, disease, soil conditions, and homeowner maintenance are beyond our control. New plantings come with a 90-day warranty from installation, covering replacement of plants that fail under normal care conditions. Hardscape installations are warranted against workmanship defects for 1 year from completion.
8. Weather Conditions
Lawn maintenance and landscaping are weather-dependent. If rain, snow, high winds, or extreme temperatures make it unsafe or impractical to perform services, we will reschedule at the earliest available date. You are not charged for weather-related cancellations. For snow removal contracts: service is triggered when snowfall reaches the threshold defined in your agreement (typically 2 inches). We make every effort to clear snow within a reasonable timeframe once accumulation triggers.
9. Snow Removal Disclaimer
Snow removal is an inherently challenging service. While we strive for thorough clearing, conditions such as ice, packed snow, refreezing, and rapid accumulation may impact results. Mow 4 U is not liable for slip-and-fall incidents, ice accumulation between service visits, or damage caused by hidden obstacles under snow. Property owners remain responsible for final walkway safety, especially for ice treatment between services. For commercial properties, you are responsible for maintaining liability insurance covering your premises.
10. Limitation of Liability
To the fullest extent permitted by Colorado law, Mow 4 U's liability for any claim arising from services provided is limited to the total amount paid for the specific service that is the subject of the claim. We are not liable for indirect, consequential, or incidental damages. Nothing in these terms limits liability for gross negligence or willful misconduct.
11. Indemnification
You agree to indemnify and hold harmless Mow 4 U, its owners, employees, and agents from any claims, damages, or expenses arising from your failure to disclose hazards, your violation of these terms, or your misuse of completed hardscape or landscape installations in ways contrary to our guidance.
12. Dispute Resolution and Governing Law
These terms are governed by the laws of the State of Colorado. Any disputes arising from services provided by Mow 4 U shall first be addressed through good-faith informal negotiation. If a resolution cannot be reached, the dispute shall be resolved through binding arbitration in Weld County, Colorado, in accordance with the Colorado Uniform Arbitration Act. Each party bears its own costs unless the arbitrator determines otherwise.
